Agreement to Terms

By accessing or using TrackerPack, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

Description of Service

TrackerPack provides time tracking and daily log management software for construction and contracting businesses. The service includes web and mobile applications for tracking employee time, managing projects, and documenting job site activities.

Account Terms

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities that occur under your account
  • You must be at least 18 years old to use this service
  • One person or legal entity may not maintain more than one free account

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Violate any laws in your jurisdiction
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with or disrupt the service
  • Transmit malware or other malicious code
  • Use the service to harass, abuse, or harm others

Payment Terms

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change our prices with 30 days' notice.

Data Ownership

You retain all rights to your data. We do not claim ownership of any content you submit to the service. You can export your data at any time. See our Privacy Policy for details on how we handle your data.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service at any time with reasonable notice. We are not liable for any downtime or data loss.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKERPACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claim arising from or related to these terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Termination

We may terminate or suspend your account at any time for violations of these terms. You may cancel your account at any time. Upon termination, your right to use the service will immediately cease.

Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes. Your continued use of the service after changes constitutes acceptance of the new terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
